Miranda rights are the right to keep silence. A suspect in the USA has the right to keep silence during the interrogation period before he gets legal help. The appointed officer has to inform the suspect of this right at the very beginning of the interrogation. The constitution of USA enacts the rule of applying for an attorney by a suspect. If he is unable to afford the same, it is the duty of the concerning authority to provide him with legal help.
Waiver:
Once the Miranda right is explained to the suspect he can waive the same by implying or expressing. In that case, the circumstance must satisfy underlying requirements-
o The waiver is made voluntarily and without official influence,
o The suspect had understood the consequence of waiving,
o The suspect is not insane or under alcoholic intoxication or of less intelligence.
The burden of proving these facts lies on the interrogating authority.
